📋 Terms of Use

Smart Refuel ("we", "us", "our") operates the Smart Refuel website and mobile-optimised web application (the "Service"). These Terms of Use govern your access to and use of the Service.

1.1 Acceptance

By accessing or using the Service, you confirm that you are at least 18 years of age (or 16 with verifiable parental consent under Irish law), that you have the legal capacity to enter into a binding agreement, and that you agree to these Terms.

1.2 Permitted Use

You may use the Service to:

• Search for and compare fuel prices at petrol stations across Ireland.
• Submit crowdsourced fuel prices at stations you have personally visited.
• Plan routes to EV charging stations.
• Earn and redeem reward coins for vouchers.
• View analytics and price predictions for personal use.

1.3 Prohibited Use

You must not:

• Submit false, misleading, or fabricated fuel prices.
• Use automated scripts, bots, or scrapers to access the Service.
• Attempt to gain unauthorised access to any account, server, or database.
• Use the Service for commercial data harvesting or resale purposes.
• Impersonate another user or provide false registration information.
• Interfere with the integrity or performance of the Service or its underlying infrastructure.

Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to An Garda Síochána where criminal activity is suspected.

👤 Accounts & Eligibility

2.1 Registration

To access protected features (Rewards, Analytics, price submission), you must create an account by providing a valid email address and a password. You are responsible for maintaining the confidentiality of your login credentials.

2.2 Account Security

You must notify us immediately at info.smartfuel@gmail.com if you suspect any unauthorised use of your account. We are not liable for losses arising from unauthorised access caused by your failure to keep credentials secure.

2.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you breach these Terms, or if we believe your activity is fraudulent or harmful to other users or the Service.

⛽ User-Submitted Fuel Prices

3.1 Accuracy & Good Faith

By submitting a fuel price, you confirm that the price is accurate to the best of your knowledge and was personally observed at the stated station on the stated date.

3.2 Submission Limits

Each registered user may submit up to 5 prices per calendar day (midnight to midnight, Irish Standard Time). Each fuel type at each station may only be updated once per day — this limit is global across all users to maintain data integrity.

3.3 Content Licence

By submitting a price, you grant Smart Refuel a worldwide, royalty-free, non-exclusive licence to use, display, aggregate, and distribute that data within the Service and in anonymised datasets. You retain ownership of your submissions.

3.4 Moderation

We reserve the right to remove or correct any price submission that we reasonably believe to be inaccurate, fraudulent, or outside our accepted price range (€0.80 – €3.50 per litre).

🪙 Coins & Vouchers

4.1 Earning Coins

Users earn 1 coin for each accepted fuel price submission, subject to the daily submission limit of 5 per user. Coins have no monetary value and cannot be sold, transferred, or exchanged outside the Smart Refuel platform.

4.2 Voucher Redemption

Upon accumulating 500 coins, a €5 voucher becomes available for redemption in your Rewards account. To redeem:

1. Navigate to the Rewards page once you have 500 coins.
2. Click the "Redeem Voucher" button that appears in your coin progress section.
3. Choose your preferred retailer from the dropdown. Available partners are:
   • 🛒 Lidl — valid at all Lidl Ireland stores
   • 🛒 Dunnes Stores — valid at Dunnes Stores nationwide
   • 🛒 Tesco — valid at Tesco Ireland stores with fuel forecourt
   • ⛽ Circle K — valid at Circle K fuel stations in Ireland
4. After confirming your selection, you will receive an email notification once your voucher has been processed and is ready to use. Please allow up to 48 hours for processing.

Retailer selection is final once confirmed. If your preferred retailer is unavailable, you may select an alternative partner.

4.3 Voucher Validity

Vouchers are valid for 180 days from the date of issue. Expired vouchers cannot be reinstated. Vouchers are non-transferable and have no cash alternative.

4.4 Partner Availability

Voucher redemption is subject to the terms and availability of each partner retailer. Smart Refuel makes no warranty that a specific retailer will be available at any given time and reserves the right to amend the list of partner retailers with 30 days' notice.

4.5 Fraudulent Activity

Any attempt to earn coins or vouchers through false submissions, account manipulation, or other fraudulent means will result in immediate forfeiture of all coins and vouchers, and permanent account termination.

🔏 Privacy Policy

Smart Refuel Ireland Ltd is the Data Controller for personal data processed through the Service. We are committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Irish Data Protection Act 2018.

5.1 Data We Collect

We use the following third-party processors (all GDPR-compliant):

• Google Maps Platform — station map display and geocoding. Google's privacy policy applies: policies.google.com/privacy
• OpenChargeMap — EV charging station data (public API, no personal data transmitted).
• MongoDB Atlas — cloud database hosted in EU data centres (Ireland/Frankfurt). Data Processing Agreement in place.

5.3 Data Sharing

We do not sell your personal data to third parties. We may share anonymised, aggregated price data (not linked to individuals) with energy research organisations. We may disclose personal data to law enforcement where required by Irish or EU law.

🍪 Cookie Policy

Smart Refuel uses only strictly necessary cookies and localStorage. We do not use advertising, tracking, or analytics cookies.

We do not use Google Analytics, Meta Pixel, or any third-party tracking cookies. The Google Maps JavaScript API may set its own cookies for map rendering; these are governed by Google's cookie policy.

7.1 Managing Cookies

You can clear localStorage at any time via your browser's developer tools or privacy settings. Doing so will log you out of Smart Refuel.

🗄️ Data Retention

Data subject to statutory retention requirements under Irish or EU law (e.g., financial records) will be retained for the legally mandated period regardless of account deletion requests, but will be isolated from active processing.

⚠️ Liability & Disclaimer

9.1 Price Accuracy

Fuel prices on Smart Refuel are submitted by community members and may not reflect current pump prices at any given station. Smart Refuel makes no warranty as to the accuracy, completeness, or timeliness of any price information. Always confirm prices at the pump before fuelling.

9.2 Predictions

AI-generated price predictions are based on historical data, seasonal trends, and geopolitical indicators. They are provided for informational purposes only and do not constitute financial, commercial, or investment advice. Smart Refuel accepts no liability for decisions made based on price predictions.

9.3 Limitation of Liability

To the fullest extent permitted by Irish and EU law, Smart Refuel's total aggregate liability for any claims arising from use of the Service shall not exceed €100. We are not liable for indirect, consequential, incidental, or special damages including loss of profits or data.

9.4 Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We reserve the right to suspend the Service for maintenance, upgrades, or emergency security measures at any time.

9.5 External Links

The Service may contain links to third-party websites (e.g., partner retailers, regulatory bodies). We are not responsible for the content or privacy practices of external sites.

📝 Changes to These Terms

We may update these Terms at any time. Where changes are material, we will notify you by email (if you have an account) or via an in-app banner at least 14 days before the changes take effect.

Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. You may close your account at any time if you do not agree to the updated Terms.

The date at the top of this page ("Last updated") will always reflect when these Terms were most recently revised.

🏛️ Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Ireland. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts.

Nothing in these Terms affects your rights as a consumer under the EU Consumer Rights Directive (2011/83/EU) or the Sale of Goods and Supply of Services Act 1980 (Ireland).
